At the beginning of 2022, the new provisions concerning the abuse of relative market power entered into force, a concept that refers to the bilateral relationship between two companies. Since then, the Swiss Competition Commission (ComCo) has initiated several proceedings and, in doing so, has further specified the application of the new legal standard. In the context of one of these proceedings, Swiss Economics examined whether the complaining company has sufficient and reasonable possibilities to switch to alternative suppliers, to what extent consumers are affected by the bilateral dependencies, and whether there are objective justifications for the conduct of the defendant company.
